Santo Domingo.- Organizaciones no gubernamentales de República Dominicana dedicadas al desarrollo de la infancia manifestaron hoy su desacuerdo con el fallo del Tribunal Constitucional del pasado 26 de septiembre.
Esa instancia determinó negar la nacionalidad a los hijos de inmigrantes indocumentados y en tránsito, una sentencia de manera retroactiva a 1929 y con el mayor impacto en descendientes de haitianos.
A los hijos nacidos en el país de padres extranjeros en tránsito no les corresponde la nacionalidad dominicana, señaló el dictamen que amplía el margen de aplicación de las leyes existentes.
Tampoco podrán solicitar el estatus de residente permanente aquellos nacidos cuyos progenitores sean extranjeros indocumentados que viven en Dominicana.

Las organizaciones también manifestaron su disponibilidad a buscar soluciones que afiancen la dignidad y los derechos de niños y adolescentes a ser tratados iguales y a vivir en libertad.
A su criterio, las decisiones tomadas y reflejadas en la sentencia deben ser vistas y analizadas desde el punto de vista jurídico, social, ético y de los derechos humanos.
El Tribunal Constitucional tomó dicha determinación ante la solicitud de amparo de una hija de inmigrantes haitianos nacida en la provincia de Monte Plata para demandar a la Junta Central Electoral (JCE) que le proporcionara documentación como dominicana.
La afectada ha vivido en dicho territorio sus 29 años de edad y tiene cuatro hijos, quienes tampoco podrán optar por su nacionalización.
Si bien nació en suelo nacional, la recurrente es hija de ciudadanos extranjeros en tránsito, lo cual la priva del derecho al otorgamiento de la nacionalidad dominicana, dictaminó el Tribunal Constitucional.
Al mismo tiempo, ordenó a la JCE auditar los libros de nacimientos del Registro Civil desde el 21 de junio de 1929 con el fin de ajustarlos a los criterios establecidos en el fallo.
